The state of Indiana passed an implied warranty “habitability and workmanship like construction”. In 1986, the Indiana Builders’ Association approached the Indiana General Assembly to clarify and address the situation, and in 1987 they passed a law that provided for the following:

If a builder:

• Warranted the home for a period of 2 years and

• Warranted the roof systems for a period of 4 years, and

• Warranted the house structurally for a period of 10 years, and

• Backed the entire warranty with an insurance program that would provide coverage if something would happen to the builder, then the “implied warranty” would be waived

The PROFESSIONAL WARRANTY CORPORATION (PWC) 2-10 extended warranty program for Indiana does all those things. Under the program:

• Coolman Builders “warrants” your home for 2 full years against construction defects

• Coolman Builders pays a one-time insurance premium to Professional Warranty Corporation to:

• Insure roof defects in years 3 & 4

• Insure against major structural defects in the years 3 thru 10

• Act as the builder if, for any reason, the builder is unable to preform

In addition, the program provides for an arbitration procedure in instances of irreconcilable differences between the builder and the buyer over warranted items.
